The Children and Families (Wales) Measure 2010 (Commencement No. 9) Order 2014
EXPLANATORY NOTE
(This note is not part of the Order)
This Order brings into effect section 11(3), (4) and section 70 of the Children and Families (Wales) Measure 2010 (“the Measure”).
The remainder of section 11 is already in force. Subsection (3) places a duty on a local authority to secure sufficient play opportunities in its area for children as far as reasonably practicable having regard to its assessment completed in accordance with its duty under section 11(1) of the Measure. Subsection (4) requires local authorities to publish information about play opportunities in their area and to keep this information up-to-date.
Section 70 sets out certain provisions in respect of guidance issued by the Welsh Ministers under the Measure to bodies that must have regard to it. Section 70(2)(a) provides that the Welsh Ministers may give guidance to bodies generally, or to one or more particular bodies. Section 70(2)(b) provides that different guidance may be issued to or in respect of different bodies. Section 70(2)(c) states that, before guidance is issued, the Welsh Ministers must consult the bodies that must have regard to the guidance. Section 70(2)(d) requires the guidance to be published.

The Welsh Ministers, in exercise of the powers conferred by section 75(3) of the Children and Families (Wales) Measure 2010([1]), make the following Order:
Title and application
1.—(1) The title of this Order is the Children and Families (Wales) Measure 2010 (Commencement No. 9) Order 2014.
(2) This Order applies in relation to Wales.
Appointed Day
2.—(1) 30 June 2014 is the day appointed for the coming into force of section 70 (guidance) of the Children and Families (Wales) Measure 2010.
(2) 1 July 2014 is the day appointed for the coming into force of section 11(3) and (4) (local authority duties in respect of play opportunities for children) of the Children and Families (Wales) Measure 2010.
